OVERVIEW OF TERMS

The SeniorsChannel website and app is operated by The SeniorsChannel Holdings Pty Ltd. It is available at www.theseniorschannel.com and may also be available through other addresses, services, or third-party distribution channels.

A licence or subscription provides a membership for the account holder. This may be an individual, a registered business, or a registered business name or entity.

Device means the way you choose to watch The SeniorsChannel, including:
• Smart TV
• iPhone or iPad that may be connected to a TV
• Third-party platforms such as CareWindow

End User means the person viewing The SeniorsChannel.

The subscription or licence is for viewing by the End User only.

Each subscription or licence provides usage from the IP address attached to the email address used to sign up. It provides permission to view The SeniorsChannel on an Apple device, a smart TV, or a computer

Subscription Service
The SeniorsChannel provides a subscription service to access digital entertainment and activities (“The SeniorsChannel content”) via the internet to certain Internet-connected TVs, computers, and other devices.

These Terms of Use govern your use of our service. As used in these Terms of Use, “The SeniorsChannel service”, “our service”, or “the service” means the members’ service provided by The SeniorsChannel for discovering and watching The SeniorsChannel content, including all features and functionalities, recommendations and reviews, the website, user interfaces, and all content and software associated with our service.


1. MEMBERSHIP

1.1 Ongoing Membership
Your The SeniorsChannel membership will continue until terminated under a monthly or annual subscription option. To use The SeniorsChannel service, you must have Internet access, a The SeniorsChannel-ready device, and provide one or more Payment Methods.

“Payment Method” means a current, valid, accepted method of payment, which may include payment through a third-party provider. Unless you cancel your membership before your billing date, you authorise us to charge the membership fee for the next billing cycle.

1.2 Membership Plans
We may offer different membership plans, including promotional plans or memberships offered through third parties. We are not responsible for third-party products or services. Conditions and limitations will be disclosed at sign-up or through other communications.

You can view your membership details by visiting the “Account” section of the website under your profile name.


2. BILLING AND CANCELLATION

2.1 Billing Cycle
Membership fees and any additional charges (including taxes or transaction fees) will be charged to your Payment Method on the billing date shown in your Account page. Billing cycle length depends on your selected subscription.

Payment dates may change due to unsuccessful payments or start dates not contained in a given month. You can view your next payment date under “Billing details” in your Account page.

2.2 Payment Methods
You authorise us to charge any Payment Method associated with your account if your primary Payment Method is unavailable. You remain responsible for any uncollected amounts.

If payment is unsuccessful and you do not cancel, access to the service may be suspended until payment is successfully processed. Some Payment Methods may incur additional fees charged by the provider.

2.3 Updating Payment Methods
You can update Payment Methods through your Account page. We may also update your Payment Methods using information provided by payment service providers.

2.4 Cancellation
You may cancel your membership at any time. Access will continue until the end of your billing period. Payments are non-refundable, and no refunds or credits are provided for partial membership periods or unwatched content.

To cancel, visit your Account page and follow the cancellation instructions. If you subscribed through a third-party provider, cancellation may need to be completed through that provider.

2.5 Changes to Pricing and Plans
We may change subscription plans or pricing from time to time. Any changes will apply from the next billing cycle after notice has been provided.


3. THE SENIORSCHANNEL SERVICE

3.1 Age Requirement
You must be 18 years of age to become a member of The SeniorsChannel service.

3.2 Corporate Licence Responsibility
Corporate Licence holders are responsible for login details and must not share access with individuals, organisations, businesses, or additional IP addresses. Breach of this condition may result in cancellation without refund.

3.3 Licence Grant
We grant you a limited, non-exclusive, non-transferable right to access and view The SeniorsChannel content during your membership. No ownership rights are transferred. Public performances are not permitted.

3.4 Licensing and Geographic Restrictions
The SeniorsChannel holds a full music licence mandate from APRA AMCOS. Content is geo-blocked and licensed for viewing in
Australia and New Zealand only. Members must not access or share content outside these regions.

3.5 Device Limits
The number of devices permitted depends on your subscription plan. Exceeding device limits may result in automatic logout from all devices and require account reset assistance.

3.6 Service Updates
The SeniorsChannel service and content library are regularly updated. We may test features, interfaces, promotions, and content availability.

3.7 Acceptable Use
You agree to comply with all applicable laws and not to copy, reproduce, distribute, modify, sell, or misuse content. You must not bypass content protections, use automated access tools, reverse engineer software, insert malicious code, or engage in data extraction.

Violation of these terms may result in termination or restriction of service.

3.8 Streaming Quality and Internet Use
Content quality may vary based on device, location, and Internet speed. Minimum recommended speeds apply for SD, HD, and Ultra HD content. Internet usage charges are your responsibility.

3.9 Software
The SeniorsChannel software may vary by device and may require third-party software subject to third-party licences. Updates may be automatically applied.


4. PASSWORDS AND ACCOUNT ACCESS

The Account Owner is responsible for all activity on the account and must protect login credentials and payment information. We may suspend or terminate accounts to protect against fraud or unauthorised activity.


5. WARRANTIES AND LIMITATION OF LIABILITY

The SeniorsChannel service is provided “as is” and without warranties. We are not liable for interruptions or errors. These terms do not limit any non-waivable consumer rights under Australian law.


6. CLASS ACTION WAIVER

Where permitted by law, you and The SeniorsChannel agree that claims may only be brought in an individual capacity and not as part of a class or representative action.


7. MISCELLANEOUS

7.1 Governing Law
These Terms are governed by the laws of Australia.

7.2 Customer Support
For assistance, contact
info@theseniorschnnel.com. In the event of conflict, these Terms of Use prevail.

7.3 Survival
If any provision is found invalid or unenforceable, remaining provisions remain in effect.

7.4 Changes to Terms and Assignment
We may update these Terms with at least 30 days’ notice. We may assign or transfer this agreement at any time.

7.5 Electronic Communications
All account-related communications will be provided electronically via email.
